This End User License Agreement ("Agreement" or "EULA") is a legal contract between you ("Licensee" or "User") and ART NETWORKS ("Licensor" or "Company"), governing your use of SportaFrame, a content management system (CMS) developed by ART NETWORKS for PHP 8.3, including any associated software, documentation, updates, or support services.
By downloading, installing, or using SportaFrame, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not use the Software.
ART NETWORKS grants you a non-exclusive, non-transferable, revocable license to use SportaFrame to create and operate a single website for one specific entity (e.g., an organization, sports club, business, or personal site). The license is limited to a single domain name and a single entity, which must be registered in the client account at the time of activation.
You are expressly prohibited from sharing, sublicensing, selling, or otherwise distributing the Software to any third party. Only the license owner is authorized to use the Software for the registered domain and associated entity.
Licensee may use the Software exclusively through the configuration/administration panel to customize website content, including uploading text, files (images, audio, video, etc.), provided that such use aligns with the intended functionality of the Software.
Licensee may not, under any circumstances:
The Software, including but not limited to its source code, design, structure, and associated intellectual property rights, is and remains the sole property of ART NETWORKS. No ownership rights are transferred to the Licensee.
Licensee is not permitted to remove, modify, or obscure any branding or credits displayed in the footer section of websites generated using SportaFrame.
Licensee must specify the exact domain name for which the Software is being used during the setup process. The license is limited to this domain, and usage on multiple domains requires additional licenses.
Any change to the registered domain will require re-activation of the license, subject to ART NETWORKS’s approval.
ART NETWORKS may provide updates to the Software, including new features, bug fixes, and security patches. Licensees are encouraged to install updates via the configuration panel to maintain software functionality and security.
ART NETWORKS reserves the right to automatically update the Software as necessary to address critical issues, ensure compliance, or enhance functionality. By using the Software, Licensee consents to receiving these updates.
Licensee acknowledges that no software is entirely free from bugs, errors, or security vulnerabilities. ART NETWORKS makes reasonable efforts to identify and resolve any such issues but does not guarantee that the Software will be free of defects or fully secure at all times. ART NETWORKS shall not be held liable for any cybersecurity breach related to the software, even if such breach results in damages.
Any feedback, suggestions, or ideas provided by the Licensee to ART NETWORKS regarding improvements or features for the Software shall be deemed non-confidential and become the exclusive property of ART NETWORKS, without any obligation to credit or compensate the Licensee.

Under the General Data Protection Regulation (GDPR), Licensees and users have the right to:
ART NETWORKS takes the security of your personal data seriously. Your data will be stored for as long as necessary to fulfill the purposes outlined in this Agreement or as required by law. Appropriate measures are taken to ensure the security of personal data.
Data collected through the Software is governed by the Privacy Policy, which is incorporated by reference into this EULA. By accepting this Agreement, you acknowledge and agree to the terms of the Privacy Policy.
To maintain compliance with this Agreement and prevent unauthorized use, ART NETWORKS reserves the right to monitor certain aspects of Software usage, including but not limited to license verification checks. Any attempt to interfere with these checks or prevent data transmission to ART NETWORKS’s servers is strictly prohibited.
SPORTAFRAME IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ART NETWORKS DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ART NETWORKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE.
Licensee may terminate this Agreement by discontinuing the use of the Software and uninstalling all copies.
ART NETWORKS reserves the right to terminate this Agreement and revoke the license if the Licensee breaches any terms of this Agreement, including misuse or unauthorized distribution of the Software.
ART NETWORKS may modify this Agreement at any time to reflect updates to the Software, legal requirements, or changes in business practices. Any such modifications will become effective upon publication in the Software or on ART NETWORKS’s website.
Continued use of the Software following the publication of any modifications to this Agreement constitutes acceptance of the revised terms. Licensee may terminate this Agreement if they do not agree with any updated terms.
ART NETWORKS reserves the right to disclose personal data to relevant authorities if required by law, or when necessary to protect the rights, property, or safety of ART NETWORKS, its users, or the public. This includes cooperating with law enforcement agencies in the event of illegal activity.
If any part of this Agreement is found to be illegal, unenforceable, or invalid by a court or other authority, the remaining provisions of the Agreement shall continue in full force and effect. The invalidity of any provision shall not affect the validity of any other provision.
This Agreement shall be governed by and construed in accordance with the laws of France. Any disputes arising from this Agreement will be resolved in the courts of France.
